PORNOGRAPHY WARNING
Use of the internet or cell phone services to receive or transmit sexually explicit material can result in a prison sentence longer than if you molested a child.
You have seen notices in the media of arrests for child pornography use. Man of these cases do not involve images of very young children or prepubescent children. They can involve pictures of anyone under the age of 17 portrayed in a sexual way. This is the age of consent for sexual activity. Despite the assurance of sites that the material is all legal, this may not be true. It is not possible to discern a naked 14 to 16 year old from an 18 to 20 year old.
Detection and prosecution of these cases has become a priority for law enforcement, including the FBI. Federal cases involve any material crossing state lines; a common factor for internet and cell phone traffic. Prosecution in Federal Court in this District, if convicted, will result in 5 to 10 years imprisonment in a Federal Prison. No leniency is shown to first time offenders. This can be a more severe sentence than conviction in local courts for touching a child.
There is no safe sexual activity on the internet or cell phones. The production and distribution of child pornography is a major crime and social problem. Do not contribute to it's growth. Your have been warned!
